These Terms and Conditions regulate the use of the Cognichat.ai website, platform, and services. By accessing the site, you confirm that you have read, understood, and agree to be bound by these Terms.
2. Eligibility
Users must be at least 18 years old, possess legal capacity to enter into binding agreements, and confirm they are not based in a country under sanctions, embargo, or trade restrictions.
3. Account Registration
Registration requires accurate information. Users must maintain credential confidentiality and take sole responsibility for account activity. Prohibited practices include registering multiple accounts without authorization and account sharing without permission.
4. Acceptable Use
Prohibited activities include violating laws, uploading harmful content, attempting unauthorized system access, distributing malware, and interfering with platform operation. Violation of acceptable use policies may result in account suspension, deletion, or legal action.
5. Intellectual Property
Cognichat SRL owns all intellectual property rights. Users cannot copy, reproduce, distribute, modify, or resell our content or services. AI-generated content may be used when explicitly permitted for personal or business purposes.
6. Paid Services and Subscriptions
Subscription features require payment. Terms include automatic renewal unless canceled beforehand, and refunds available per consumer rights provisions.
7. Delivery of Services
All services are digital, delivered online immediately after registration or payment, with no physical products shipped.
8. Disclaimer of Warranties
The platform is provided "as is" and "as available" with no warranties regarding continuous operation, compatibility, suitability, or freedom from malware.
9. User Rights (Consumers)
EU/UK consumers may withdraw within 14 days of purchase if the service has not been accessed. Refunds process within 14 days. EU consumers receive a 2-year legal guarantee on digital services.
10. Limitation of Liability
Company liability excludes indirect damages and is capped at amounts paid in the past 12 months, except for fraud, gross negligence, or damages to life, health, or physical integrity.
11. Indemnification
Users agree to indemnify and hold harmless Cognichat SRL from claims arising from misuse, Terms violations, or third-party infringement.
12. Service Interruptions and Maintenance
Services may be temporarily suspended for maintenance with advance notice when possible.
13. Privacy
Personal data use follows the Privacy Policy available on our website.
14. Changes to Terms
Updates become effective upon publication; continued use implies acceptance.
15. Governing Law and Jurisdiction
Romanian law governs these Terms, with Bucharest courts handling disputes.
